Terms of Service

These terms govern the use of the Ammit Discord bot and its web portal (https://panel.ammitbot.com), as well as the purchase of Ammit Premium subscriptions. They serve as general terms of use and general terms of sale.
1. Publisher
The Ammit service is published by TyXe0 Digital, 70 AVENUE DE GRASSE, 06800 CAGNES SUR MER, FRANCE, SIREN 131471211.

2. Purpose and acceptance
Ammit is a moderation, protection and community bot for Discord servers. Its web portal lets server owners, and the members they authorise, configure it, follow their server's activity and take out a Premium subscription.
Adding the bot to a server, using its commands or signing in to the portal constitutes acceptance of these terms. If you do not accept them, do not use the service.
The service is intended for people who meet the age requirements set by Discord. A Premium subscription may only be taken out by adults or by people acting with the permission of their legal representative.
3. Description of the service
Ammit comes in two versions:
- the free version, with no time limit: moderation, logs, basic protections (anti-raid, anti-nuke, account security), tickets, publications, community tools and statistics, within the limits shown on the "Subscription and features" page of each server;
- the Premium version, by subscription: advanced features and higher limits, as presented in the portal shop at the time of the order.
What is active on a server and what Premium unlocks is shown in the portal, based on the actual state of the service. No feature is presented as available if it is not.
The currency of a server's economy has no monetary value. It cannot be bought and cannot be exchanged for any money, goods or services, on the server or elsewhere. It only exists on the server that uses it: the server's team can adjust or reset it, and it disappears with the server's data.
The service depends on Discord and its interfaces. If Discord is unavailable, the bot is unavailable too, and the publisher cannot be held liable for it.
4. Account and access to the portal
The portal account is created and opened with your Discord account, on the portal or from the personal link sent by the bot or obtained with the `/setup` command. A valid email address is required at sign-up: it is used for communications about the service and for billing. A Discord account can only be linked to one portal account.
You are responsible for the security of your Discord account and for every action taken with your account. Report any unauthorised use to support@ammitbot.com without delay. Open sessions and sign-in history can be viewed in My account › Security and connections, where each session can be closed.
A server owner can give partial access to their moderation team and to writers. This access is checked on every page against the roles actually assigned on Discord; the owner remains responsible for how it is used.
The information you provide (email address, contact details) must be accurate and kept up to date: it is used for communications about the service and for billing.
5. Rules of use
You agree to:
- comply with Discord's terms of service and community guidelines;
- use Ammit only on servers you own or for which you have permission;
- not use the service for unlawful purposes, to harass, to discriminate or to infringe the rights of others;
- not try to bypass the security mechanisms, access data that is not intended for you, disrupt the service or make abusive automated use of it (including of the HTTP API);
- not copy, modify, decompile or disassemble the code of the bot or the portal, except where the law allows it;
- not introduce malicious software, and not query the service with robots or scripts outside the HTTP API and its limits;
- only distribute through the bot and the portal content that you hold the rights to and that complies with the law;
- not resell, sublet or assign a subscription to a third party (transferring it to another of your servers remains possible, section 9).
Sanctions and automatic actions applied by the bot on a server result from the settings chosen by the owner and the decisions of their team. The owner is responsible for the configuration of their server and for the rules they enforce on it.
6. Content distributed with Ammit and reports
The texts, messages, publications, custom commands and images you configure in Ammit are distributed under your responsibility. The publisher does not check them before they are distributed. It may remove or block clearly unlawful content that is reported to it, or whose removal an authority requests; it then informs the author, with the reason, unless the law forbids it.
To report unlawful content distributed with Ammit, including on the public pages of www.ammitbot.com, write to support@ammitbot.com, stating the address or server concerned, the content in question and why it is unlawful. This address is also the point of contact for authorities and users provided for by the European Digital Services Act (Regulation (EU) 2022/2065).
7. Premium subscription: offer and prices
A Premium subscription covers one Discord server. To cover several servers, you buy one subscription per server, from the same account; each has its own duration and its own due date. The durations (1, 6 or 12 months) and prices are those shown in the portal shop at the time of the order. Prices are shown in euros, including all taxes where a tax applies; the applicable VAT statement appears on the invoice.
The price of the first payment may reflect a duration discount, a current promotion or a promo code. A promo code only applies to the first payment of the order in which it is entered, under the conditions announced with it (validity, number of uses, new customers only); it cannot be combined with a gifted period. Renewals are charged at the normal price of the period, as shown before the order.
The publisher may change its plans and prices. A change never applies to a period already paid; for a subscription that renews automatically, it is brought to your attention before the renewal concerned, which you can then stop.
The publisher may offer Premium periods (for example 1, 7 or 15 days) to an account, to all users or through a gift code. A gifted period involves no payment and ends at its term. A gift code can be used only once, before its expiry date if it has one; it can neither be exchanged for money nor refunded.
Limited offers. The publisher may run limited offers, announced by a banner on the portal and on www.ammitbot.com with their conditions: free duration, number of places and, where applicable, end date. An offer ends on that date, or as soon as its places are taken.
- At sign-up: every account created during the offer, within the limit of places, receives a gift subscription, only one per Discord account. It is activated as soon as Ammit is present on a server the holder manages and which has never had Premium, provided this happens within one hour of signing up. After that, the offer is lost. It can only be transferred to a server that has never had Premium. A server benefits from it only once.
- On first purchase: the first paid order of an account that has never paid for a subscription receives the announced free months, within the limit of places. Payment is made when ordering and the free months are added at the end of the first period; with automatic renewal, the next charge is postponed accordingly. These months cannot be combined with a promo code giving free days.
An unused place (gift subscription not activated in time, refunded payment) goes back to the offer.
8. Order and payment
Orders are placed from the portal: choice of the plan in the shop, then of the duration, the renewal and the server to cover in the cart (price recalculated by the service, never from data sent by the browser), then confirmation of the order after accepting these terms.
Payment is made through a secure payment provider, Stripe or PayPal, as you choose. Your payment details (card number, PayPal account) are entered and stored by the provider: Ammit never has access to them and stores none of them.
The subscription is only recorded once the provider confirms the payment. Its period starts on the day it is activated on a server: at the order if you chose the server, otherwise from My account › Subscription. As long as the subscription is not activated, its period does not run. It must be activated within 10 months of payment; after that, its period starts on its own and you can still choose the covered server until the due date.
Only a server where Ammit is installed, which you own or administer and which does not already have Premium can be covered. With PayPal, automatic renewal requires choosing the server when ordering. As long as an order is not paid, it stays "awaiting payment" in My account › Orders and payment and can be cancelled free of charge; an unpaid order is abandoned automatically after a few days.
An invoice is issued by the service for every payment received; it is available in My account › Invoices and payments and sent to the account's confirmed email address.
9. Duration, renewal and termination
A subscription covers the duration chosen at the order, from its activation on a server. With automatic renewal and a card payment, the next charge takes place at the end of this first period.
With automatic renewal, a new payment is charged by the provider at each due date, at the normal price of the period. You can stop the renewal at any time from My account › Subscription: Premium stays active until the end of the period already paid, then the covered server goes back to the free version. A renewal stopped with Stripe can be reactivated before the due date. With PayPal, the renewal relies on a payment authorisation given to PayPal; withdrawing it from your PayPal account also stops the renewal.
Stopping the renewal amounts to terminating the subscription at its due date. An email confirms the request and states the date Premium ends. For a 6- or 12-month subscription that renews automatically, an email reminds you, between three months and one month before the due date, of the renewal date, its price and how to stop it.
Transfer. The holder of a subscription can transfer it to another server from My account › Subscription. The destination server must have Ammit, be managed by the holder (owner or administrator) and not already have Premium. The due date does not change. A transfer is possible once every 30 days, or at any time if Ammit has left the covered server or if that server no longer exists. The former server immediately goes back to the free version, with its settings kept.
Without automatic renewal, the subscription ends at its due date. It can be extended from the portal: the new period starts at the current due date, without interruption.
If a charge fails, the provider may retry it; a short grace period is allowed before Premium ends. A refunded or disputed payment ends the corresponding period.
At the end of a subscription, Premium settings are kept but no longer apply; no server data is deleted, and the free version's protections remain active.
10. Right of withdrawal
You have fourteen days from the payment to withdraw, without giving any reason, by writing to support@ammitbot.com (or from My account › Subscription during the first 5 days), for example with the form in the appendix. If the subscription has not been activated, the payment is refunded in full. If you activated it on a server during this period, you asked for the service to start before the end of the period: the refund is reduced by the share corresponding to the time already elapsed.
The refund is made within fourteen days of your request, using the payment method used for the order.
11. 5-day guarantee and refunds
5-day guarantee. The first payment of a subscription is refunded on simple request from its holder, within 5 days of that payment, from My account › Subscription. The refund is made by the payment provider, to the payment method used; the subscription stops immediately, renewal included, and the covered server goes back to the free version, with its settings kept. A credit note is issued.
The guarantee does not apply to renewals, extensions or gifted periods. Outside the guarantee and the right of withdrawal, periods that have started are not refunded, unless the law provides otherwise or the service fails through the publisher's fault. Any other request is examined case by case: write to support@ammitbot.com with the order reference or the invoice number. A refund granted gives rise to a credit note.
12. Legal guarantee of conformity
Consumers benefit from the legal guarantee of conformity for digital content and services (articles L224-25-12 et seq. of the French Consumer Code). For a subscription, the publisher is liable for any lack of conformity that appears during its whole duration. In case of a defect, you can ask for the service to be brought into conformity; if that is impossible or does not happen within a reasonable time, you can ask for a price reduction or for the contract to be terminated. 13. Availability, maintenance and changes
The publisher strives to keep the service running continuously, without any guarantee of permanent availability. Interruptions may occur for maintenance, updates, failures or unavailability of third-party services (Discord, hosting, payment providers).
If the subscription service is temporarily unavailable, a Premium server falls back to the free version, never below it; Premium settings are kept and apply again as soon as the service is back.
The publisher may change the service (adding, changing or removing features). The removal of a Premium feature during a subscription entitles you, on request, to stop the renewal.
If the publisher permanently stops operating Ammit, it announces it at least 30 days in advance on the portal and by email. Renewals are stopped, the unused part of paid periods is refunded, and account data can be exported until closure.
14. Personal data
The data processed by Ammit, the purposes and retention periods are described in the privacy policy, which forms part of these terms.
15. Intellectual property
The Ammit name, its emblem, its code and its texts are the property of the publisher. They may not be reproduced or used without permission, outside normal use of the service.
The content you publish or configure (messages, rules, channel names, publications) remains yours; you grant the publisher the right to process it only to the extent necessary for the service to work.
16. Liability
The service is provided with the reasonable means of a diligent publisher. The publisher cannot be held liable for:
- moderation decisions taken by an owner or their team, nor automatic actions resulting from the chosen settings;
- unavailability or malfunctions attributable to Discord or another third party;
- indirect losses (loss of data you did not back up, loss of members, revenue or reputation).
In all cases, the publisher's liability towards a subscriber is limited to the amount paid for the subscription over the last twelve months. These limitations do not apply to damages that the law does not allow to be excluded.
17. Suspension and termination by the publisher
The publisher may suspend an account, deactivate a subscription or remove the bot from a server in the event of a breach of these terms, abusive use, payment fraud or a legal obligation. Except in an emergency, you are informed and can reply to support@ammitbot.com. Termination for breach does not give rise to a refund.
The publisher may also suspend access to an account if there is serious doubt about its security, for example a compromised Discord account, until the situation is resolved.
18. Changes to the terms
These terms may be changed. The date of the last update is shown at the top of the document; a substantial change is announced on the portal or by Discord message. Using the service after the new terms come into force constitutes acceptance; otherwise, you can stop using the service and stop the renewal of your subscription.
19. Applicable law and disputes
These terms are governed by French law. In the event of a dispute, an amicable solution is sought first.
For any complaint, write to support@ammitbot.com with the order or account reference: you will receive an answer within 15 days.
Failing an amicable agreement, the French courts have jurisdiction, subject to the protective rules applicable to consumers.
20. General provisions
If a clause of these terms is declared void, the others remain applicable. Not relying on a clause at a given time does not mean giving up the right to rely on it later. Neither party is liable for a failure caused by force majeure within the meaning of article 1218 of the French Civil Code.
